Miami Woman Arrested after Kicking Dog “Like a Football”, Slapping Dog Several Times Outside Miami Restaurant

Advocacy

A shocking news story regarding a Miami woman who allegedly engaged in a brutal beating of her dog outside of a Miami restaurant earlier this month has some Miami residents wondering just what the laws in Florida are when it comes to animal cruelty. According to local news reports, on Sunday, March 9, Miami resident Fabiola Annelie Noel, a 30-year-old woman, was arrested and charged with serious animal cruelty charges. Reports detail that on the Sunday that Noel was arrested, she had allegedly kicked and slapped her dog outside of the Katz Restaurant and Lounge at 738 Northeast 125th Street in Miami. Arrest reports indicate that “a witness said she saw Noel ‘kick her dog like she was punting a football’ and said Noel picked the dog up several feet off the ground and choked the dog using the leash.” Another witness came forward regarding the alleged attack of the dog by its owner, stating that “he saw Noel hitting or slapping her dog four or five times.” Noel was then arrested by Miami Police Officers and charged with animal cruelty with intent to injure or kill. Noel was ultimately booked into jail, and her dog was removed from her custody to Miami-Dade Animal Control. Noel was appointed a public defender to defend the animal cruelty charges against her, and she was granted a $5,000 bond.

Animal Cruelty Crimes Under Florida Criminal Laws

In light of the arrest of Fabiola Noel for the alleged beating of her dog in front of the Katz Restaurant and Lounge, it is important for Miami residents to understand the seriousness of animal cruelty charges under Florida criminal laws. Under Florida criminal laws, “animal cruelty” is defined as “every act, omission, or neglect whereby unnecessary or unjustifiable pain or suffering is caused, except when done in the interest of medical science, permitted, or allowed to continue when there is reasonable remedy or relief….” If a person is convicted of misdemeanor animal cruelty in Miami, they may face up to 1 year in jail, and a fine of up to $5,000. Felony animal cruelty is punishable by up to 5 years in prison and a fine of up to $10,000 under Florida criminal laws. As demonstrated, a person who is charged and convicted of animal cruelty in Miami may face significant jail time and penalties. Accordingly, those charged with animal cruelty in Miami should reach out to an experienced Miami criminal attorney as soon as possible to defend them against the charges.
