Miami Beach Man Arrested after Assaulting Bar Employee, Hurling Racist Insults, Now Facing Disorderly Conduct Charges

A Miami Beach man is facing criminal charges after allegedly making a racist and violent scene at a Miami Beach bar. According to local news reports, Michael Nixon, 42 years old, from Arlington, Virginia, was arrested after he refused to pay his bar tab. Investigators believe that Nixon visited Norman’s Tavern in Miami Beach on Sunday, January 19. At the bar, Nixon was eventually presented with a $130.81 bar tab, which caused him to erupt into violence and racist speech. According to the arrest report in the case, in response to his bar tab, Nixon yelled profanities at the bartender. When the manager of the bar attempted to intervene between Nixon and the bartender, Nixon spewed at him, “Hola, English motherf*****, I live in America, you speak English,” and, “F***ing Trump is going to deport your a**.” Nixon was reported to have then punched another bar employee in the face. He was also reported to have left the bar, then returned to the bar, where he was arrested by police officers without incident. The case provides one example of how a night out can turn ugly, and how a person can find themselves hit with criminal charges after an altercation at a bar.
Disorderly Conduct under Florida Laws
The case also demonstrates one example of what constitutes disorderly conduct under Florida criminal laws. Under Florida criminal laws, “Whoever commits such acts as are of a nature to corrupt the public morals, or outrage the sense of public decency, or affect the peace and quiet of persons who may witness them, or engages in brawling or fighting, or engages in such conduct as to constitute a breach of the peace or disorderly conduct, shall be guilty of a misdemeanor of the second degree….” Accordingly, a conviction of a crime of breaching the peace or of disorderly conduct is a serious charge, and those who have been charged with breach of the peace or disorderly conduct in Miami should speak with an experienced Miami criminal attorney about their case as soon as possible.
