Can a common household item that is not intended for violence be considered a deadly weapon in Miami under Florida criminal laws? A case from Boca Raton indicates that it just may be. According to local news reports the Miami New Times, 52-year-old Mark Roher was arrested and charged with felony aggravated battery with a deadly weapon after his violent behavior involving a dinner plate in the carving station line of a wedding. On January 18, Roher, a local attorney, attended a wedding at the Boca Lago Country Club, where the dinner options for guests included a carving station for a prime rib dinner. While in the line, a man who was in front of Roher allowed two young girls, one of whom was his own daughter, to cut in line in front of him for the prime rib dinner. According to reports, this aggravated Roher to the point that he confronted the man in front of him verbally, and yelled at him. However, the man in front of him did not respond, and ignored him. Then violence broke out. According to the police report detailing the incident, “The slimmer man ignored the man yelling at him and did not respond…Without provocation, the large, bald man struck the slimmer man on the head with a dinner plate. From thereon, a melee began between a large number of the wedding guests.” In addition, witnesses to the incident, including an employee at the Palm Beach County country club, indicated that “…the plate had shattered and that [Roher] pushed the victim and was holding him by the collar.”

After police intervened in the incident, they took Roher’s statement. Roher admitted that he was upset that he was cut in the prime rib line, but he denied that he had hurt anyone and that he had smashed a plate on the man in front of him. He also noted that the wedding was a “dry” wedding, and that he had not consumed any alcohol. He complained of his own injuries before being escorted out of the country club by police.

For his role in the prime rib melee, Roher was ultimately charged with aggravated battery with a deadly weapon, and he and his wife were banned from visiting the Boca Lago Country Club for one year. It remains to be seen what will happen in the case, and whether Roher will beat the charges against him.
